e-MarketingSystems.com provides its Web service to you, subject to the following "Terms of Service", which may be updated or changed by us from time to time without notice to you. In addition, when using particular e-MarketingSystems.com web services, you shall be subject to any posted guidelines or rules applicable to such web services which may be posted from time to time. All such guidelines or rules are hereby incorporated by reference into the "Terms of Service". By using the Service, you agree to be legally bound and to abide by the Terms of Service, just as if you had signed this Agreement. If you do not comply with the Terms of Service, e-MarketingSystems.com has the right to suspend or terminate your account and refuse any and all current or future use of the Web Service (or any portion thereof). TERMS & CONDITIONS e-MarketingSystems.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Web Service (or any part thereof) with or without notice. You agree that e-MarketingSystems.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. If you have prepaid us for a service, we will carryout the service before any changes take place. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Web Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that e-MarketingSystems.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Web Service. You acknowledge and agree that e-MarketingSystems.com may preserve Content and may also disclose Content if required doing so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the "Terms of Service". We use emails to communicate with you to confirm your placed orders and to send information that you have requested. By using our "Service" you agree to receive special offers and updates from us by E-Mail. You also agree that we may post any feedback from you through our "Customer Satisfaction Survey" on our web site that may include, your name and URL we submitted. e-MarketingSystems.com will not be liable, if you receive any unsolicited submission confirmation emails as a result of your order. We recommend using a secondary free email address such as Hotmail to keep unwanted emails away. We have a 100% NO SPAM Policy. If you find that any of the search engines we submitted to are sending you spam email, please forward us a copy of the email and we will remove them from our submission list.In consideration for the services purchased by you and provided to you by e-MarketingSystems.com, you agree to pay e-MarketingSystems.com at the time service is provided. Payment is to be made by you providing a valid credit card for charge by e-MarketingSystems.com and is non-refundable. If for any reason e-MarketingSystems.com is unable to charge your credit card with the full amount owed e-MarketingSystems.com for the service provided, or if e-MarketingSystems.com is charged back for any fee it previously charged to the credit card you provided, you agree that e-MarketingSystems.com may pursue all available remedies in order to obtain payment. The said company e-MarketingSystems.com reserves the right, where services have been fulfilled within the Stated time frames listed in this Terms of Service and the customer, however still reverses credit card charges, a debt collection agency will be commissioned, who will then recover payment for services rendered. You agree that among the remedies e-MarketingSystems.com may pursue in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to you of any Services registered or renewed on your behalf. e-MarketingSystems.com takes no responsibility for incorrect or false information inputted on any e-MarketingSystems.com order forms such as an email address or URL's . We do not submit URL's that resolve to a secure server https. It is the responsibility of the Customer to make sure that we are notified of a valid email address to send reports to. However, we will attempt to contact the Customer from information on the forms that are provided for registration. If after the said maximum registration process period of 3-10 working days has lapsed and you haven't received reports, it is the responsibility of the Customer to email us with the correct email address so we can re-send the reports to you. No responsibility is taken if your web site(s) are not accepted by Search Engines or indexed to the expectations of the Customer, this is at the search engines discretion and is beyond our control. There is no guarantee as to how many search engines will except your website. There is no guarantee redirected or forwarded URL's will be excepted by search engine indexes. There is no guarantee as to how long the search engines will keep your listing in their database. e-MarketingSystems.com shall not be responsible for URLs dropped or excluded for any reason. It is the responsibility of the customer to notify e-MarketingSystems.com for cancellation of their account due to inactive URL's that are no longer online. e-MarketingSystems.com shall not be responsible for delays or failure of performance resulting from internet service provider delivery problems or failure, or any communication or delivery problems associated with the Customer's order details, such as incorrect email addresses or URL addresses. It will take (3-10) working days not including weekends to complete the order process. The said company reserves the right to set a maximum registration process to the Search Engines of three to ten working days not including weekends. Any reasons beyond our control that causes your order not to be completed within the said maximum timeframe due to a problem with the router systems, hard drives, internet downtimes, extreme congestion, fire, flood, vandalism or act of God, the said company reserves the right to complete the technical services of the orders within 30 days at time of placement of the order excluding weekends. If any term of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then this Agreement, including all of the remaining terms, will remain in full force and effect as if such invalid or unenforceable term had never been included. LIMITATION OF LIABILITY YOU EXPRESSLY UNDERSTAND AND AGREE THAT E-MARKETINGSTYSEMS.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF E-MARKETINGSYSTEMS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE. NOR SHALL CLIENTS DAMAGES EXCEED THE AMOUNT OF THE PURCHASE PRICE OF THE SERVICES. |
